Welcome to Premium Level Marketing Inc. (“we,” “us,” or “our”). By accessing or using our digital marketing services (the “Services”), you agree to be bound by the following Terms and Conditions. If you do not agree with these terms, please refrain from using our Services.

1. Services Provided

Premium Level Marketing Inc. provides a range of digital marketing services, including but not limited to:
• Search Engine Optimization (SEO)
• Social Media Management
• Pay-Per-Click (PPC) Advertising
• Email Marketing
• Content Creation
• Website Design and Development

The scope of work for each client will be outlined in a separate agreement or proposal.

2. Client Obligations

By engaging with our Services, you agree to:
• Provide accurate and complete information necessary for the provision of our Services.
• Comply with all applicable laws, including but not limited to intellectual property and advertising laws.
• Obtain any necessary permissions or consents for us to perform Services on your behalf (e.g., for email marketing campaigns under CASL).

3. Payment Terms

• Fees for our Services will be outlined in a separate proposal or agreement.
• Payment is due as specified in the agreement, typically within 30 days of the invoice date unless otherwise stated.
• Late payments may incur interest at a rate of 1.5% and may result in suspension of Services.

4. Confidentiality

Both parties agree to maintain the confidentiality of any proprietary or sensitive information shared during the course of the business relationship. This obligation will survive the termination of the agreement.

5. Privacy and Data Protection

Premium Level Marketing Inc. is committed to protecting your privacy. Any personal information collected in the course of providing our Services will be handled in accordance with Canadian privacy laws, including PIPEDA.

• As a client, you agree to ensure compliance with privacy laws when sharing personal data with us.

6. Compliance with Canadian Anti-Spam Legislation (CASL)

• We adhere to the requirements of CASL when conducting email marketing campaigns.
• Clients must ensure that any contact lists provided for email campaigns consist of recipients who have provided valid consent.
• We will not be held responsible for any penalties resulting from non-compliance with CASL due to inaccurate or incomplete data provided by the client.

Intellectual Property

• All materials created by us during the provision of Services (e.g., graphics, ad copy, website content) remain our property until full payment is received.
• Upon full payment, intellectual property rights will transfer to the client unless otherwise specified in the agreement.

8. Limitation of Liability

To the fullest extent permitted by law:
• Premium Level Marketing Inc. shall not be liable for indirect, incidental, or consequential damages arising from the use of our Services.
• Our total liability for any claim, whether in contract, tort, or otherwise, shall not exceed the amount paid by the client for the Services in question.

9. Termination

• Either party may terminate the agreement with 30 days written notice.
• We reserve the right to terminate or suspend Services immediately if you breach these Terms and Conditions or fail to make timely payments.

10. Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada. Any disputes will be subject to the exclusive jurisdiction of the courts of Ontario.

11. Modifications to Terms and Conditions

We reserve the right to update or modify these Terms and Conditions at any time. Clients will be notified of significant changes, and continued use of our Services after such changes constitutes acceptance of the revised terms.
